Welcome to Whole Food Formulas. These Terms of Service ("Terms") govern your access to and use of the website at wholefoodformulas.com (the "Site") and any products purchased through it. By using the Site or placing an order, you agree to these Terms.

If you do not agree to these Terms, please do not use the Site or purchase products from us.

1. Who we are

Whole Food Formulas is operated by NutriPlex Formulas, Inc., a Colorado corporation. Throughout these Terms, "we," "our," and "us" refer to NutriPlex Formulas, Inc.

2. Eligibility

You must be at least 18 years old to purchase products from this Site. By placing an order, you confirm that you are 18 or older and legally able to enter into a binding contract.

3. Your account

You may purchase as a guest or create an account. If you create an account, you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at hello@wholefoodformulas.com if you believe your account has been accessed without your permission.

4. Purchases and payment

  • Pricing. All prices are in US dollars unless otherwise noted. We reserve the right to change prices at any time, but changes will not affect orders already placed.
  • Payment. Payment is due at the time of purchase. We use Shopify Payments to process transactions. By submitting an order, you authorize us to charge your selected payment method for the total amount of the order, including applicable taxes and shipping.
  • Order confirmation. A confirmation email is sent after each successful order. Your order is accepted when we send the confirmation. If we are unable to fulfill an order, we will contact you to arrange a refund or substitute.
  • Availability. Products are subject to availability. If a product becomes unavailable after you order, we will notify you and refund any amount you were charged.

5. Subscriptions

Products purchased through our Subscribe & Save program are governed by our Subscription Policy, which is incorporated into these Terms by reference. By starting a subscription, you agree to recurring billing on the cadence you select until you cancel.

6. Shipping and delivery

We ship within the United States. Delivery times and shipping costs are shown at checkout and vary by destination and service selected. Orders are fulfilled directly by our supplier, NutriPlex Formulas, and tracking information is provided when the order ships.

Risk of loss passes to you when the product is delivered to the carrier.

7. Returns and refunds

You may return unopened products within 30 days of delivery for a full refund of the product price.

  • Shipping costs both ways are the customer's responsibility unless the product arrived defective or we shipped the wrong item.
  • Opened products are generally not returnable. If a product is defective, damaged, or incorrect, contact us within 7 days of delivery and we will make it right.
  • Subscription orders have their own refund window. See our Subscription Policy.

To start a return, email hello@wholefoodformulas.com with your order number and reason for return.

8. Product information and disclaimer

We work hard to describe our products accurately, but we do not warrant that descriptions, images, or other content on the Site are error-free, complete, or current. Colors and packaging may vary slightly from what is displayed online.

These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. Information provided on the Site is for educational purposes only and is not medical advice. Consult a qualified healthcare professional before starting any new supplement, especially if you are pregnant, nursing, taking medication, or have a medical condition.

9. User conduct

You agree not to use the Site in any way that:

  • Violates any applicable law or regulation
  • Infringes on the rights of others
  • Attempts to gain unauthorized access to systems or accounts
  • Introduces viruses, malware, or other harmful code
  • Scrapes, harvests, or otherwise collects information from the Site without our permission
  • Impersonates another person or entity

We may suspend or terminate your access to the Site if we believe you have violated these Terms.

10. Intellectual property

All content on the Site, including text, images, logos, product photography, formulations, and written materials, is the property of NutriPlex Formulas, Inc. or our content partners and is protected by United States and international copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works of any content without our written permission.

The Whole Food Formulas name and logo are trademarks of NutriPlex Formulas, Inc.

11. Third-party services and links

The Site may contain links to third-party websites, services, or resources. We are not responsible for the content, policies, or practices of any third-party site and linking does not imply endorsement.

12. Disclaimer of warranties

The Site and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the servers that host it are free of viruses or other harmful components.

13. Limitation of liability

To the fullest extent permitted by law, NutriPlex Formulas, Inc. and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Site or the products purchased through it.

In any case, our total liability to you for any claim arising out of or relating to these Terms or your use of the Site will not exceed the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless NutriPlex Formulas, Inc. and its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site or the products.

15. Governing law and jurisdiction

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms will be resolved in the state or federal courts located in Boulder County, Colorado, and you consent to the jurisdiction of those courts.

16. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent changes. Material changes will be communicated by email to active account holders or by a prominent notice on the Site. Your continued use of the Site after the effective date of any change constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
